1. Introduction

Welcome to simplecgt ("we", "us", "our", or the "Platform").

These Terms of Service ("Terms") govern your access to and use of our website, software, calculators, tax estimation tools, filing assistance tools, content, and related services (collectively, the "Services").

By creating an account, accessing the Platform, or using any part of the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

If you do not agree to these Terms, you must not use the Services.


2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Services.

You represent and warrant that all information you provide when creating an account is accurate and complete.

  • AI-generated responses;

No adviser-client, accountant-client, solicitor-client or fiduciary relationship is created through your use of the Platform.

Errors, omissions, delays, software bugs, calculation issues or inaccuracies may occur.

The Services are provided on an "as is" and "as available" basis.

You acknowledge and agree that:

  • Outputs may not reflect all aspects of your circumstances;
  • Guidance may be incomplete;
  • Tax laws may change without notice;
  • Results should always be independently reviewed before being relied upon.

6. User Responsibility

You remain solely responsible for:

  • Reviewing all information generated by the Platform;
  • Verifying the accuracy of all calculations;
  • Ensuring all information entered into the Platform is accurate and complete;
  • Determining whether any tax treatment is appropriate;
  • Ensuring compliance with applicable laws and regulations;
  • Meeting filing deadlines;
  • Making tax payments;
  • Reviewing any forms, returns or submissions before filing.

Any tax return, declaration, submission or filing made using information generated through the Platform remains entirely your responsibility.

You acknowledge that we are not responsible for decisions you make based on the Services.


7. User Input and Data Accuracy

The accuracy of calculations and outputs depends upon the information provided by users.

You are solely responsible for ensuring that all data entered into the Platform is accurate, complete and up to date.

Incorrect, incomplete or misleading information may produce inaccurate results.

We accept no responsibility for inaccuracies arising from user-provided information.


8. No Guarantee of Revenue Acceptance

Use of the Platform does not guarantee:

  • Acceptance of any filing by the Revenue Commissioners;
  • Approval of any relief, credit or deduction;
  • Compliance with tax laws;
  • A particular tax outcome;
  • Avoidance of audits, enquiries or reviews;
  • Avoidance of penalties or interest.

Any decision made by the Revenue Commissioners or other authority remains outside our control.


9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for:

  • Tax liabilities;
  • Underpayments of tax;
  • Penalties;
  • Interest charges;
  • Surcharges;
  • Audits;
  • Investigations;
  • Revenue assessments;
  • Lost profits;
  • Loss of business;
  • Loss of data;
  • Loss of goodwill;
  • Indirect losses;
  • Consequential losses;
  • Special damages;
  • Incidental damages.

You acknowledge that use of the Platform is entirely at your own risk.

Where liability cannot be excluded by law, our total aggregate liability arising out of or relating to the Services shall not exceed the greater of:

(a) €100; or

(b) the total amount paid by you to us during the twelve (12) months preceding the event giving rise to the claim.


10. Indemnity

You agree to indemnify, defend and hold harmless simplecgt, its directors, officers, employees, contractors and affiliates from any claims, losses, liabilities, damages, penalties, costs or expenses arising from:

  • Your use of the Services;
  • Your breach of these Terms;
  • Your tax filings or submissions;
  • Information provided by you;
  • Your violation of applicable laws.

11. Intellectual Property

All software, content, branding, trademarks, designs, text, graphics, calculators, workflows and intellectual property associated with the Platform remain the exclusive property of simplecgt or its licensors.

You may not copy, modify, distribute, reverse engineer, reproduce or exploit any part of the Services without prior written permission.


12. Account Security

You are responsible for maintaining the confidentiality of your login credentials.

You are responsible for all activity occurring under your account.

You must notify us immediately of any unauthorised access or security breach.


13. Service Availability

We do not guarantee uninterrupted access to the Platform.

The Services may be modified, suspended or discontinued at any time without notice.

We shall not be liable for any interruption, downtime, technical failure or unavailability of the Services.


14. Privacy and Data Protection

Your use of the Services is also governed by our Privacy Policy.

We process personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR) and applicable Irish data protection laws.

By using the Services, you acknowledge that your personal data may be processed as described in our Privacy Policy.

Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Ireland.
